The U.S. Supreme Court overturned the landmark 1973 Roe v. Wade decision Friday, sending the authority to regulate and restrict abortions back to the states. Democrats and liberals sharply criticized the ruling. Republicans celebrated the decision.
Act 47 of 2019, which guarantees a woman’s right to choose an abortion, was the law of the land in Vermont before Dobbs, and it will be the law of the land after Dobbs.
Today’s U.S. Supreme Court decision changes the legality of abortion in our state. Passage of H. 57, now Act 47, is clear statutory protection of unlimited and unregulated abortion throughout all nine months of pregnancy.
With the Supreme Court overturning Roe v. Wade, they acknowledge that abortion is not a constitutionally-protected right. The issue will now be decided by the people and the elected officials in their respective states.
Proper cause to carry concealed is a common requirement of state or local jurisdictions if you need to apply for permission to exercise that right, but the U.S. Supreme Court just declared it unconstitutional. The case is New York State Rifle and Pistol Association v. Bruen.
This Supreme Court ruling is directly applicable to Vermont. Vermont’s tuition assistance program is very similar to Maine’s. Vermont will have to consider how to reconcile the Carson v. Makin opinion with the Compelled Support Clause in the Vermont Constitution.
In Carson v. Makin, the court ruled 6-3 against the program which excluded students attending religious K-12 schools from taxpayer-provided tuition assistance. “Indeed, were we to accept Maine’s argument, our decision in Espinoza would be rendered essentially meaningless,” Chief Justice John Roberts wrote.
Republican Sen. Marco Rubio of Florida told Fox News host Sean Hannity on Wednesday that rhetoric aimed at conservatives was “playing with fire” in the aftermath of the attempted assassination of Supreme Court Justice Brett Kavanaugh and was encouraging violence.
Those 29 examples raise the question: When should stare decisis justify continuing a ruling in force, and when should a questionable case be overturned in light of changing facts, arguments and consequences?
The Massachusetts Supreme Judicial Court ruled that the state could proceed with its lawsuit against ExxonMobil and that a free speech law didn’t protect the company’s activity in question. Massachusetts Attorney General Maura Healey filed the lawsuit against ExxonMobil in 2019.
