NYT reporters say editors removed exculpatory information about Kavanaugh; Sanders had called for ouster

By Chuck Ross and Chris White

The co-authors of a new book about Brett Kavanaugh blamed New York Times editors on Monday for removing a key passage from an essay they published over the weekend that laid out a new, but uncorroborated, sexual misconduct allegation against the Supreme Court justice.

In an interview with MSNBC’s Lawrence O’Donnell, Times reporters Robin Pogrebin and Kate Kelly addressed the controversy over a New York Times Review essay they published on Saturday that previewed their book, “The Education of Brett Kavanaugh: An Investigation.”

The essay focused on uncorroborated allegations that Deborah Ramirez made against Kavanaugh in 1983, when they were both students at Yale. It also revealed that a Washington, D.C.-based lawyer named Max Stier told the Senate last year about another incident he claims involved Kavanaugh and another woman. Stier reportedly said that Kavanaugh had his penis out at a party at Yale, and that a friend grabbed it and thrust it in a female student’s hand.

But as Fox News contributor Mollie Hemingway (who has written a Kavanaugh book of her own) noted, Pogrebin and Kelly’s book had additional information about the most recent allegation that was exculpatory for Kavanaugh. Buried at the back of the book was the revelation that the woman in question refused to be interviewed and that her friends said she did not recall the incident.

After backlash across the political spectrum, The Times eventually added a correction to the story on Sunday that included the full passage from the book.

Pogrebin, Kelly and the Times all came under heavy scrutiny over the omission. Jim Dao, the Times editor who handled the article, conducted a Q&A sessionwith readers concerned over how the story was handled. But Dao did not address how the key passage from the book was left on the cutting room floor, or whether editors indeed decided to remove it.

“In your draft of the article, did it include those words that have since been added to the article?” O’Donnell asked the reporters.

“It did,” they both replied.

“So somewhere in the editing process those words were trimmed?” the MSNBC host asked.

Pogrebin theorized that the passage was cut because it also identified the woman who they alleged had the encounter with Kavanaugh. The reporter said that editors likely cut the full passage as they cut the name of the alleged victim.

“I think it was sort of an editing, done in the haste, in the editing process, as you know, a closing section,” she said.

Both reporters denied that they intended to mislead readers in the essay.

“There was zero intent to mislead anybody about the details of the incident,” Kelly said.

“We certainly never intended to mislead in any way. We wanted to give as full a story as possible,” added Pogrebin.

They also acknowledged that they took part in the discussions to add the correction to the Times story.

“I think we felt like there’s so much heat, everyone has been kind of seizing on various aspects of this that we certainly didn’t want this to be an issue anymore,” Pogrebin said.

Democratic Candidates Called For Kavanaugh’s Ouster

Democratic presidential candidates called for Congress to impeach sitting Supreme Court Justice Brett Kavanaugh after a report Saturday resurrected allegations against the justice.

“I sat through those hearings. Brett Kavanaugh lied to the U.S. Senate and most importantly to the American people,” California Sen. Kamala Harris said in a tweet Sunday. “He was put on the Court through a sham process and his place on the Court is an insult to the pursuit of truth and justice. He must be impeached.”

Harris was reacting to a story Saturday in The New York Times from reporters Robin Pogrebin and Kate Kelly, who authored a forthcoming book about the justice called “The Education of Brett Kavanaugh: An Investigation.” The pair reported they reached seven individuals who could further corroborate Deborah Ramirez’s accusation.

Other 2020 Democrats have made similar comments regarding the report. “It’s more clear than ever that Brett Kavanaugh lied under oath. He should be impeached,” former Housing and Urban Development Secretary Julian Castro said on Twitter Saturday night.

“The revelations today confirm what we already knew: During his hearing, Kavanaugh faced credible accusations and likely lied to Congress,” Vermont Sen. Bernie Sanders tweeted Sunday. “I support any appropriate constitutional mechanism to hold him accountable.”

Another candidate was more circumspect. “My concern here is that the process was a sham. I don’t think you can look at impeachment hearings without getting the documents … and the attorney general is shielding documents,” Democratic Sen. Amy Klobuchar of Minnesota said in an ABC interview Sunday morning.

President Donald Trump, meanwhile, blasted the report and told his Twitter followers Sunday that Kavanaugh “should start suing people for libel.”

  1. Facts? Bernie and his ilk could less about facts? There’re typical lib/dem/progs. As soon as they latch onto a half baked, uncorrabed allegation about someone they perceive to be the enemy, they jump into the pool fully clothed. Then when the rest of the story comes out debunking the charge, rather than apologise, they change the subject and let these false charges dangle in the air. Should any decent individual be surprised???

  3. This is much worse than McCarthyism. Can you imagine how these miscreants would squeal if the foot was on the other shoe?
    Unreal.

  4. It’s amazing that these liberals can do and say whatever they want with never any consequences but if it’s a conservative they are to be prosecuted and to be put in prison. What a nation this is becoming.
The liberal news is becoming more corrupt every day.

  5. California Sen. Kamala Harris is a liar. According to her father. And I see no reason to believe her, either. Harking back to Biden’s “truth over facts”: That is ideological truth over veridical truth. Ideological truth can exist in defiance of contradicting reality. The earth is the center of the universe; Copernicus is a heretic, an apostate for mathematically proving it isn’t.

  6. More BS to slander someone, no proof just hearsay but these Liberal fools just publish it
anyway……. Time for Kavanaugh to start suing these incompetent fools.

    Innocent until proven guilty !!
