The U.S. Supreme Court on Friday rejected the state of Texas’ lawsuit seeking to overturn presidential election results in four key swing states.
“The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution,” the nation’s highest court wrote in an unsigned ruling released Friday evening. “… Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot.”
The decision means the Electoral College is likely to vote Monday to confirm presumptive President-elect Joe Biden will be the next president of the United States.
The U.S. Supreme Court
Eighteen Republican attorneys general filed briefs with the U.S. Supreme Court in support of Texas’ lawsuit against the states of Georgia, Michigan, Pennsylvania and Wisconsin over their election procedures. The District of Columbia filed a brief on behalf of 22 Democratic states and territories in support of the four swing states.
The court’s ruling dismisses all related motions.
In a comment accompanying the Supreme Court’s brief ruling, Associate Justice Samuel Alito said he would have accepted the case but not grant other relief.
“In my view, we do not have discretion to deny the filing of a bill of complaint in a case that falls within our original jurisdiction,” Alito said. “… I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.”
Associate Justice Clarence Thomas joined Alito in his written comment.
In its lawsuit, Texas claimed officials from the four defendant states violated Constitutional provisions in the way they conducted their state elections, illegally altered election laws without legislative approval, and removed ballot integrity measures, which impacted other states by affecting the outcome of the election.
When an election is certified in a state, Electoral College “electors” who support the candidate who won the popular in the state are appointed to cast their ballots for president. Texas’ lawsuit asked the court to bar those electors from voting, and instead have the respective states’ legislatures select the electors. Biden, a Democrat, won the popular vote in each of the four defendant states. Republicans control the legislatures in each state.
The Supreme Court ruled that Texas did not have standing to interfere in other states’ election processes.
“The U.S. Supreme Court saw through this seditious abuse of the judicial process, and its swift denial should make anyone contemplating further attacks on our election think twice,” Pennsylvania Attorney General Josh Shapiro said in a statement after the ruling. “While these stunts are legally insignificant, their cost to our country – in misleading the public about a free and fair election and in tearing at our Constitution – is high and we will not tolerate them from our sister states or anyone else.”

With all due respect, Bruce, especially to the TNR crew that maintains this forum, rarely do I see comments I would characterize as mere banter. And when they are, I ignore them. Most comments, on the other hand, are highly informative and add to the reader’s understanding of the published content. After all, the articles you choose to publish are provocative too, and your readers can choose to read or ignore them as well.
Consider the last paragraph of this story from The Center Square, citing the clearly incendiary comments by PA officials. For example, when the article quotes the characterization of those questioning the validity of this previously untested voting process in the courts, as a ‘seditious abuse of the judicial process’, ‘stunts…legally insignificant’, ‘misleading the public about a free and fair election’, and ‘tearing at our Constitution’, is it inappropriate to reply in kind?… not only to the author, but to those who provide similar comments.
I suggest, if you have the time of course, that when you see a comment that offends your sensibilities, call it out and substantiate your point of view. Because, in the final analysis, most criticisms are ultimately constructive in one way or another.
My comment is to everyone: keep things civil, on topic, and respectful of others’ views. We aim to encourage broad participation and diverse viewpoints, and civility is key to fostering a climate of open conversation and participation.

Thanks Mr. Parker for the reminder.
One thing I have found helpful is before I push send is make sure it is something I would be willing to say at Town Meeting before my neighbors and fellow townspeople. Having participated in every town and school meeting in our town for over 40 years and including covering them for the Herald of Randolph for 28 years, I have seen pretty intense disagreement at times; but it has always been kept well within civil bounds and does not get personal.
This may be due in part to what Paul Searles describes so well in his book “Two Vermonts: Geography and Identity 1865-1910” as the knowledge that in rural towns that you may at one point be dependent for help in one way or another on your fellow townsperson and best not to let disagreements get to bitter. This might be something that may actually have larger relevance for our country as well where ultimately we will need to depend on our fellow countrymen, even if we disagree on many things, to meet our nations challenges.
Tho you issue plenty of directives may I suggest you take your own advice.
– Would you address a female member of your community publicly as “Mr” and upon objection declare you didn’t know she “was a lady”, try it and watch the room clear
– Would you approach a conservative member of your community and advise them to accept the loss of their election if asking for a legally accepted recount
There’s plenty more however as one who has shown inability to take own medicine perhaps you should stop forcing it upon other community members
I’ve always thought, perhaps there could be a rating on commentators done by the pubic. That way people who bring up good information, relevant can be moved up and others can be not so well promoted.

AN ABUNDANCE OF FAKE MAIL-IN BALLOTS
The counting of many votes was performed mostly by registered Democrats in Democrat-controlled cities in swing states. These cities, such as Detroit, Michigan, and Philadelphia, PA, have decades of experience manufacturing votes.
Even if the rest of the swing states would vote for Trump, Biden would “win” in the end, which is exactly what occurred.
Statistical Analysis of Election Date: Statistical analysis, by PhD-level professionals, comparing past voting patterns with that of the 2020 Election, shows Trump having a high probability of winning, and Biden having a minuscule probability of winning, i.e., the opposite result could happen only due to outside intervention, i.e., fraud.
Counting All Sorts of Ballots: Because Trump had a 700,000-vote lead over Biden at about 10 PM, November 3 (Election night), in PA, Jesse’s 280,000 votes were not nearly enough to close that enormous gap.
There must have been major anguish/panic among Democrat party operatives regarding what to do to close the gap.
The gap had to be closed by whatever means necessary, and in a short time, to cement a Biden win.
Billions of dollars of federal COVID aid money to Philadelphia were at stake.
Power and command/control of the White House, and US Senate, and US House were at stake.
Political platforms were at stake.
The much-written about Blue Wave was at stake

Hundreds of people must have been involved to: 1) get a supply of ballots and envelopes, 2) fill in ballots, 3) backdate envelopes by the USPS, 4) sign envelopes, 5) put addresses on envelopes, to have them appear genuine.
In the real world, oversize envelopes, passing through the USPS, have wear marks, folds, etc.
There was no time to “age” the envelopes.
OMG, they looked soooo new!
Dead people, some of them dead for more than 10 years, were registering and voting; that is a real trick
People moved to another state years ago, or recently, were voting in their new state and their prior state; double voting
Illegal aliens and other non-citizens, with a driver’s license ID to get registered, were voting.
Temporary residents were voting.
People, who appeared in person to vote, were told “you already voted”, i.e., they had been surreptitiously voted.
Without effective poll-watching, or no poll-watching, i.e., in secret and during off-hours, the same Biden ballots were run through counting machines multiple times, according to sworn affidavits by poll workers.
Signature-matching, when called for by GOP poll watchers and others, was resisted at all costs.
That means there were more votes for Biden than there were paper ballots!!
In some counties, more people voted than were registered.
Whereas, the Bethpage, NY, fake mail-in ballot operation had been planned in detail and executed months in advance of the Election, such a leisurely pace was no longer possible.
Sloppiness took place
Mistakes were made
Windows were boarded up to hide what was going on
Poll watchers were kept at a distance, or out of the building, with help of the local police.
Counting machines broke down.
It all looked like an out-of-control THIRD WORLD BANANA REPUBLIC
In very short order, about 400,000 Pennsylvania mail-in ballots, appeared on November 4, to help reduce the rest of the 700,000-vote gap in favor of Trump.
The legacy US Media quickly proclaimed Biden THE President-elect, which, by law, would be confirmed by the US Congress in January, 2021.
The legacy US Media pitched-in with clever blathering about “free and fair elections, and “no widespread voter fraud that would alter the outcome” to make things appear plausible/palatable to at least 75 million befuddled Americans, who had voted for Trump.

The suit should have been brought, not by Texas, but by people in Georgia, or Michigan, etc., who would have standing, because those people would likely be able to claim harm from the measures taken by Election workers (illegally back-dating envelopes, curing ballots, waiving signature verification, etc.), without getting formal STATE Legislature approval, as required by the STATE Constitution, and ultimately the US Constitution.

Perhaps correct, but in states where there are criminal activities or activities that fly in the face of the constitution, nationally and locally, that state is unlikely to press charges.
For instance, look at Vermont.
Do we see anything happening in support, from those whom might support the constitution, our voting integrity, the integrity of valid candidates?
Sometimes the only way for a state to get justice is for another state or fed to step in. A practical Vermont example. In the 80’s when there was so much savings and loan fraud committed, they could not find any attorney in Chittenden county to investigate. They had to go outside the county, everybody was afraid to step on another’s toes.
Welp, if the President can’t win this, we are moving towards two things, #war or the breakup our of country, maybe both.
We are moving to the end of the Union, I can feel it.
Red states will move towards secession.
Rush even sees it coming, we can not co-exist with the people that want to install a woman into the Oval Office that is an anchor baby that was the first one to drop out of the Primary with less than 2% of the vote.

The Supreme Court has failed the nation, and the world.
There is of course another option. Accept the results and move on as after any other election in this nation. After all, over 40 court cases could not prove widespread fraud in this election including in cases brought before Trump appointed Justices ,Trump’s own Attorney General could not find evidence of widespread fraud, and multiple recounts verified the results. Donald Trump has the option of running again in 2024 and already has a large base of support and considerable war chest. A good fight has been fought and for some, a battle lost, but that is not the end of the ongoing saga of America.
There will be as there always have been push and pull over what and how much government should do. Some politicians will always be corrupt, need to be exposed and prosecuted. Those in power, from either party, will often overstep what mandates they feel the voters gave them and will be voted out of office ( See Mitzi Johnson) or not get the higher office they seek ( See Tim Ashe and David Zuckerman). Also the tension between Freedom and Unity embodied in our state’s motto has and will exist beyond our short lifetimes.
Our Country may not be perfect and may disappoint many of us at one time or another, yet even with its flaws it is the better than any of the alternative forms of government that have been tried. Call me sentimental, but I still get chocked up when at the start of our Lions Club meetings we say the Pledge of Allegiance in which we swear our loyalty to “the flag of the United States of America and to the Republic for which it stands, one nation under God with liberty and justice for all. We are part of a noble experiment. While we might not always agree, the ability to say our piece, listen to others, and actively engage in the politics of the day without fear, is indeed special and should be cherished even when in the short term, election results are sometimes not what we would have liked.

Laura, the good news is that no one will force you to consider Joe Biden “your” President. Not only that, but in our system of government the President’s power is far from absolute and balanced by the legislative and judicial branch at the federal level and a good deal of state powers and responsibilities as well.
While President Trump was defeated in this election, overall Republicans did quite well. There are and will be plenty of opportunities going forward for those who favor smaller government, individual freedom and responsibility, adherence to our immigration laws, and bottom up rather than top down decision making, to have our voices heard and our concerns acted upon.

It is understandable how deeply disappointed some are by the results of this election; especially those who may have bought in to such fanciful propositions as the “Release the Kraken lawsuits”. However, it might be worth considering what key Republicans appointed by Trump who were in charge of insuring the safety of the election, investigating fraud, or sitting in judgement have to say.
Christopher Krebs, the Director of Cybersecurity and Infrastructure Security Agency in the Department of Homeland Security called this election “the most secure in American history”. “in every case of which we are aware, these claims (of fraud) have been unsubstantiated or are technically incoherent”
Attorney General William Barr on December 1 said that U.S. Attorneys and FBI officials have been working to follow up on specific complaints and information they have received, but have not uncovered enough evidence that would change the outcome of the election.
Trump appointed Federal Judge Stephanos Bibas wrote the following in the Pa. case brought by Rudi Giuliani: “Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here. The campaign’s claim has no merit”. His two fellow judges, both appointed by Republican Presidents, agreed.
Perhaps Founding Father John Adams said it best, “Facts are stubborn things; and whatever our wishes, our inclinations, or dictates of our passions, they can not alter the state of fact and evidence.
There he goes again. Mr. Freitag is diverting attention from the true matter at hand…. his dishonesty. My comments have had little if anything to do with my disappointment regarding an arguably dysfunctional, if not fraudulent, election. But that’s not the point.

Anyone without their cranial-rectal-insertion knows what the Clinton funded Steele Dossier was, how it was used by the FBI and FISA Courts to perpetrate a fraudulent Russia hoax claim, leading to the Mueller investigation. They know that the Obama administration knew about it too. They now know Joe Biden and his son had ‘questionable’ financial dealings in Ukraine and China. And still, 3 years after the 2016 election, the Democrats didn’t ‘move on’, they tried to impeach Trump, falsely accusing him of doing precisely what Biden actually did – use the threat of U. S. government backed loans to stifle an investigation.

Seventeen states have joined the Texas SCOTUS suit, regarding violations of the US Constitution, related to the elections in Pennsylvania, Michigan, Wisconsin, and Georgia.
SCOTUS dismissed the suit, due to Texas, et al., lacking standing. The plentiful merits of the suit were not mentioned.

Remedies Using a Different Venue
The suit should have been brought, not by Texas, but by entities in Georgia, Michigan, Wisconsin, Pennsylvania, etc., who would have standing, because those entities would likely be able to claim harm from the illegal measures taken by Election workers.

Bush administration in 2008, who he said “could not have been more professional or more gracious in making sure we had a smooth transition”
The same day, United States Secretary of Defense Ash Carter issued a memo to the United States Armed Forces informing them of the pending transfer of National Command Authority to a new administration. Also on November 9, the U.S. Intelligence Community offered the full President’s Daily Brief to Trump and Mike Pence.

This is how the post election was handled in 2016 and it is similar to how it has been handled, to the credit of both parties, in the past.

This may be how Obama, Clinton and you, want everyone to believe the 2016 post-election was conducted. But your apparently pathological disregard of the circumstances surrounding the never-ending claims of Trump’s Russian collusion, the Mueller investigation, and Trump’s impeachment, is indicative of this continuing hypocrisy.
Consider, for example, that November 10th meeting you cite – in which “Former President Barack Obama warned then-President-elect Donald Trump about Michael Flynn during their Oval Office meeting two days after the election,” – initiating the setup of Trump for the Russian collusion hoax and everything that followed.

Laura this story is a really bad story – author is owner of a website that is a 501c3 partially funded by Koch and was called out by a Breitbart writer in 2010. We need to recognize there are many Trumphaters in the GOP as we can plainly see from VT alone and not sure what political party he’s in but lengthy MSM career. So trusting of TNR sources didn’t bother to check things out. When I read this story was a gutpunch that sent me reeling. Felt like a treed cat was really depressed and awakened depressed it felt like we were already under Communist control. After reading a bunch of stories was able to talk self down from the tree. Have been listening to the Joshua Rally from DC and feel much better – whew.
