State Supreme Court strikes down noncitizen voting in NYC

The New York Supreme Court ruled Monday in favor of a lawsuit against giving noncitizens the right to vote in local elections.

The Republican National Committee (RNC) sued New York City Mayor Eric Adams, the New York City Council and the New York City Board of Elections in January for passing a law allowing noncitizens to vote.

In its decision, the New York Supreme Court said that there’s no legal authority allowing non-citizens to vote.

“There is no statutory ability for the City of New York to issue inconsistent laws permitting non-citizens to vote and exceed the authority granted to it by the New York State Constitution,” the state supreme court said in the decision.

“Though voting is a right that so many citizens take for granted, the City of New York cannot ‘obviate’ the restrictions imposed by the Constitution,” it added.

The lawsuit alleged that around one million noncitizen adults live in New York City, adding that the number of noncitizens eligible to vote in local races could comprise 15% or more of the vote. It claimed that the law violated the state constitution that requires voters to be U.S. citizens.

“Today’s ruling is a huge victory for election integrity and the rule of law: American elections should be decided by American citizens. The [Republican National Committee (RNC)] is proud to head a broad coalition in successfully challenging this unconstitutional scheme and will continue to lead the effort across the country to ensure only citizens can vote in America’s elections,” RNC Chairwoman Ronna McDaniel said in a statement.

Neither the New York City Council nor the New York City Board of Elections responded to The Daily Caller News Foundation’s requests for comment.

Mayor Adams’ office referred TheDCNF to the city’s law department, whose spokesperson called the ruling “disappointing … for people who value bringing in thousands more New Yorkers into the democratic process.”

“We are evaluating next steps,” the spokesperson added.

  1. Voting is a privilege allotted to its citizens, if you want to be able to vote then become a US
    citizen, the only ones wanting unverified or illegal voting are “The Blue States ” it’s not that
    they really care about noncitizens, they believe that this will keep them in power in order to
    pass their agenda………………… snakes in the grass, and Vermont has plenty !!

  2. In New York City there are about 800,000 non-citizen foreigners, illegal or not, work permit or not, etc., who were registered to vote in Municipal Elections, as a result of Mayor Adams instigating the passing of a NYC rule to allow it.

    This would great dilute the vote of legitimate voters, including the black vote, who ARE US citizens

    The NY State Supreme Court ruled the NYC rule unconstitutional, because the NY Constitution states only US citizens are allowed to vote in any government election, such as Presidential, Senatorial, Gubernatorial, and Municipal.

    It looks like Vermont also has a problem, allowing non-citizens to register and vote.

    Vermont Town Clerks are not allowed to even ask for:

    citizens papers, and
    birth certificate, and
    proof of residency, and
    any photo ID,
    BY LAW, COURTESY OF CONDOS, ETC.

    Anyone can walk in, sign an affidavit, register, and vote, and there is NOTHING ANY TOWN CLERK CAN DO ABOUT IT.

    • Amen to that. Remarkable what the Dems will do to win. And Bernie does it to this day! Condos need to examine voter rolls in Burlington. Bernie started it all way back when to WIN at any cost. Voter fraud. Bernie won the Burlington mayoral by 12 VOTES. How did he do it? He registered 200-300 ILLEGAL UVM students to vote, and he STILL DOES, every election. What he does is get his grass roots tye dye ignorants to go to UVM and seek out all over18. Then they have to check if they are in a DORM, or an APT. They only take ones in apartments, for a legitmate seeming ADDRESS – off campus. Then they register these student Dems to vote. But MOST of them are OUT OF STATE. NO one checks to see if these Bernie voters are VT residents. They pay out of state tuition. They may have cars registered OUT OF STATE. They file NO VT INOCME TAXES…yet they are allowed to vote as VT RESIDENTS and never cross checked…because the Progressive Activists know it is fertile ground at UVM to get hundreds and hundreds (or more) of illegal votes….for PROGRESSIVES! And look what the Progressives did to REDISTRICT the whole UVM area a couple years ago. They TWISTED the “new” vote district like thin spaghetti…to make SURE they encompass ALL the known…RENTAL APARTMENT areas that are close to campus! Total Democrat voter fraud, year in and year out.

      • Oh, it get’s worse, the possible vote fraud Burlington. Majority of UVM kids who get apartments are Juniors and Seniors. THINK! When they graduate and leave BTV, DO they bother to remove their names on the voter list? NOPE! So Burlington will MAIL vote ballots to apartment addresses where they no longer live. And WHO get’s those mail in ballots, to possibly mail in (along with their own false ballots)? Yup. All the other Progressive UVM Bernie’s! I would bet that Burlington has been mailing out ballots to students who have not been in Burlington for YEARS. They never bothered to check. And I am being conserrvative to say maybe 300 illegal voters….It could be closer to 1,000. and that can swing Burlington elections?
