Government watchdog demands probe into New York attorney general’s climate crusade debacle

A prominent government watchdog group is demanding New York officials probe the state attorney general for using former New York City Mayor Michael Bloomberg’s legal group to target energy companies.

New York-based Government Justice Center (GJC) filed an ethics complaint Friday against New York Attorney General Barbara Underwood for using two special assistant attorneys paid for by Bloomberg Philanthropies. GJC wants the state Joint Commission on Public Ethics (JCOPE) to investigate the Democrat.

“New York public officials are ethically obligated to follow the law and conduct state business without giving the impression of being improperly influenced by others,” Cameron Macdonald, executive director of the GJC, wrote in a press statement attached to the complaint. The ploy was first implemented under Underwood’s predecessor, former New York Attorney General (AG) Eric Schneiderman.

“And the extraordinary powers of New York’s Attorney General, especially under New York’s unique Martin Act, are being rented to a third-party special interest,” he added. Underwood’s office was provided two assistant AGs – Matthew Eisenson and Gavin McCabe – to help the state defend against potential environmental regulation rollbacks.

The complaint comes shortly after The Daily Caller News Foundation reported in October that McCabe signed an amicus brief in June supporting New York City’s yearlong climate lawsuit against Exxon and Chevron. He’s one of at least eight attorneys hired by attorneys general across the country to work on environmental litigation.

The city’s lawsuit is the third such claim brought against oil companies Exxon, Chevron, BP, Royal Dutch Shell and Conoco Phillips. Another judge in Northern California struck down identical lawsuits in June brought by the cities of San Francisco and Oakland. The legal maneuvers are a boon for trial lawyers as well.

Some critics believe Bloomberg Philanthropies is being used as a type of pass-through entity through which donors can support elected officials with resources that legislatures will not provide and which donors cannot legally provide directly.

Oregon AG Ellen Rosenblum also raised alarms in June after her office hired environmental lawyer Steve Novick as a special assistant attorney general (SAAG). Rosenblum is a longtime Democrat and politician who has served as the state’s top law enforcer since 2012.

“Are we sure it is correct to refer to him as a ‘volunteer.’ And not an employee,” Rosenblum asked her deputy AG in a June 17 email. “Can you be an unpaid employee of the State? As a SAAG doesn’t that make one an employee?” Her email was included in a June report from the Competitive Enterprise Institute detailing the extent of Bloomberg’s campaign.

  1. Climate changes. The probability of stopping climate from changing is nil. If Exxon and Chevron turned out the lights, locked the doors and furloughed the employees does the AG think the climate will stop changing? Massive socioeconomic disruption for an energy dependent society, turn us into a third world country (seemingly a Progressive goal anyway), but alter the way climate changes? That’s going to be hard (expensive, of dubious and extremely difficult validation). I doubt there’s any way to prove it. There’s at least an equally large body of theory that vindicates the petroleum industry, that demonstrates the benefits they bring us far outweigh the costs. As always, the long suffering working class will pay the bills for both sides since regardless of who wins or loses, taxes pay for one side and higher energy costs pay for the other side. AGW is a fanatic religion comprised of Jim Jones charlatans selling the Solyndra solution – Sacrifice to Save the World. They even demand Penance in the form of carbon taxes and sell Carbon Indulgences to sinners like the Renaissance church. Pushed it a little too far in France, didn’t they?
