Fact Check: Condos’ defense of S.15 riddled with falsehoods and inaccuracies

On May 18, Vermont Secretary of State Jim Condos distributed a commentary in defense of S.15, an elections bill under debate in the Vermont Legislature that would make permanent the practice of mailing live ballots to all active voters regardless of request.

What follows is my point-by-point refutation of claims made by the secretary of state regarding the content and potential impact of S.15 on Vermont elections. The refutations are set apart in italics below.

Vermont Elections are Safe and Secure

The big lie, perpetuated by former President Trump and some of his supporters, is that our elections are not secure. These dangerous and disingenuous claims are made without evidence to support them. The former President and his supporters have filed over 60 lawsuits across the country to try to steal the election. All but one were dismissed or ruled against because of a lack of evidence.

FALSE: 1 (ROPER’S RESPONSE). There is considerable evidence that Vermont’s election laws under the 2020 Covid-19 measures and prospectively under S.15 are not secure. Testimony from Town Clerks and the Director of Elections confirms this. What is not clear is if or to what degree this lack of security is being exploited. 2. The majority of those 60 lawsuits were dismissed due to lack of standing by the plaintiffs, not lack of evidence.

The claim that mailing a ballot to every active, registered voter will make our election system less secure is grounded in the same unfounded logic, yet the same trumped up voter fraud fearmongering is being used to try and stop S. 15, which will make the mailing of ballots to every voter a permanent feature of general elections. In reality, Vermont’s elections process is very secure.

FALSE (ROPER’S RESPONSE). In reality, hearings before the Government Operations Committees of the House and Senate revealed that:

1. Town Clerks and the Director of Elections testified that there is NO WAY to determine if an absentee ballot was filled out and returned by the voter to whom the vote is being attributed. 

2. Town Clerks and the Director of Elections testified If someone gets hold of someone else’s ballot, or multiple ballots, fills them out and sends them in fraudulently, those votes will almost certainly be processed and counted.

3. Town Clerks and the Director of Elections testified that the only indication a fraudulent vote may have been cast is if an absentee ballot is received, and a voter shows up at the polls and disputes the validity of the absentee ballot. However:

    • In a high turn-out election as many as 35% voters choose not to vote — their votes can be stolen without possibility of detection. 
    • There is no way to independently verify that the voter did not actually send in their absentee ballot and is in fact voting twice. And,
    • If the voter is telling the truth, they will be allowed to cast a legitimate ballot, but with 30 days of early processing of absentee ballots, there is no way to remove the fraudulent vote from the final count. 

4. All of the states that currently do vote-by-mail have some sort of voter ID provision for absentee ballots whereby election officials can independently verify that the ballot was filled out by the voter to whom the votes are being attributed. We can’t say “it works there so it will work here, if we don’t employ the same safeguards here that allow it to work there.” 

In fact, the MIT Election Performance Index state rankings for 2016 and 2018 ranked Vermont #1 and #3 respectively in election administration.

MISLEADING (ROPER’S RESPONSE): The 2016 and 2018 elections, which did not see ballots mailed to all active voters without request, can’t be honesty compared to 2020, or be used to project outcomes for 2022 and beyond. The proposed changes to election law in S.15 radically change the way we administer elections, but do not adapt new security measures to match new vulnerabilities in the new system.

According to the experts, the 2020 election was the most secure election in US. history, and the most scrutinized. Across the country, interest in and observation of election procedure has never been higher.

UNSUPPORTED (ROPER’S RESPONSE). What experts exactly? Cite your sources.

As states and voters increasingly relied on vote by mail, we did not see any evidence of increased rates of voting irregularities or election rigging.

MISLEADING (ROPER’S RESPONSE). All other states that utilize vote by mail systems employ strict security measures specifically designed to maintain ballot security for absentee ballots, such as signature matching or other independently verifiable ID requirements. S.15 has no such security provisions. Places that used emergency vote by mail provisions in 2020 but with security measures, such as Patterson, NJ, did, in fact, see significant voting irregularities.

What we did see was record shattering turnout despite the health challenges presented by a global pandemic.

MISLEADING (ROPER’S RESPONSE). While turnout was, in fact, way up in 2020, it had more to do with public interest in the election than with the adoption of vote by mail. In fact, if you look at the history of states adopting vote by mail as a primary way of running elections (Oregon, Colorado, Utah, Washington), they all saw voter turnout fall or remain flat in the election year following their adoption of the policy.

Vermont voters overwhelmingly embraced the steps we took to make our elections safe and secure. Over 75% cast the ballots mailed to them early or by mail, and voter turnout was the highest in history.

IMPORTANT POINT (ROPER’S RESPONSE): This criticism is not a condemnation of voting by absentee ballot as a concept. Only that to implement a radically new method of running elections, with glaring holes in ballot security, recognized and admitted by election officials, with no measures to shore up those holes is beyond negligent.

If enacted, S.15 will make the mailing of ballots to all Vermont voters a feature of future general elections. Its passage received broad support by Republicans, Democrats, Progressive and Independents.

Our democracy is stronger when we all participate. The mailing of general election ballots to all voters will make our elections more accessible for all Vermonters, regardless of political party or viewpoint.

DEBATABLE (ROPER’S RESPONSE): Analysis of the latest Census data by the Wall Street Journal revealed that the states with the longest history of standard vote-by-mail systems, Oregon and Colorado, rank second worst and fifth worst for Black v. White racial disparities in turn out. Other studies show that voting by mail leads to minority populations having their ballots rejected for errors at a rate between 2 and 3 times than for other demographic groups.

Voting by mail has been a part of U.S. elections since before the Civil War. Many Vermonters serving active duty in the military rely on it to securely cast their ballots. In the last 10+ years we have seen voting by mail grow substantially here and across the country.

Yet rates of fraud have remained the same: infinitesimally small. In Vermont, Town Clerks referred 7 potential cases of 2020 voter abnormalities to my office. Only one was found to be actionable: a voter attempted to vote twice to prove he could dupe the system. He was caught and his test only proved that the system works. It was reported, investigated, and prosecuted.

ANOTHER WAY OF READING THAT (ROPER’S RESPONSE). The fact that Town Clerks only reported seven cases of potential fraud could mean that fraud doesn’t occur, or it could mean that under the vote by mail system fraud is nearly impossible to detect. Honestly, do you really think that no one in this state in 2020 filed out a ballot for their spouse, or aging parent? No one filled out a ballot that accidentally landed in their mailbox, even by mistake? Or is this evidence of the lack of quality control in the process?

If S.15 is enacted, ballots will only be mailed to active registered voters, directly contradicting the ridiculous implication that ballots will be sent carelessly around the state. The Post Office will not forward ballots for people who have changed addresses; those undeliverable ballots will be returned to the Town Clerk.

FALSE (ROPER’S RESPONSE). Sending ballots to all active voters on the checklist will, even in a high turnout election, result in as many as 200,000 unwanted or unclaimed ballots floating around the countryside. True, many if not most will be returned as undeliverable or destroyed by be the honest people who inadvertently receive the. But, many will fall through the cracks and present a tempting opportunity for large and small scale fraud.

Advancements in technology and policy have made our voter data more accurate than ever. Online and automatic voter registration provides a constant stream of updates as voters relocate, and we receive data from other states when voters move and register.

For an early ballot to be counted the Clerk must receive it in the certificate envelope, with a signed affidavit that the voter is who they say they are. These envelopes contain other voter data, including a unique identification number and barcode specific to that voter.

SO WHAT? (ROPER’S RESPONSE) None of the information provided by the person filling out the envelope is independently verifiable by election officials. Anyone can fill out the form, and Clerks testified that such fraud cannot be detected, and the vote will be processed. The bar code is a reliable tool for knowing who the ballot was intended for, and for whom the vote will be attributed, but it is useless for verifying who filled out and remitted the ballot.

These certificates are signed under the pains and penalties of perjury. Voting someone else’s ballot is a crime which carries substantial penalties.

SO WHAT? (ROPER’S RESPONSE) There is no way to catch someone who fills out another person’s ballot, rendering the penalties meaningless.

When the Clerk receives a ballot, the voter is checked off the entrance checklist as having voted. Since we track the data for every ballot that is mailed out, if a second ballot shows up anywhere in the state for that voter, we can investigate.

YES AND NO (ROPER’S RESPONSE). The system we have and would have under S.15 is pretty good an ensuring two votes are not attributed to the same voter. If one votes absentee then shows up in person to try to vote again, that person will get caught. However, as Clerks testified, if someone steals someone’s absentee ballot and the legitimate person shows up to vote in person, no only is it unlikely that the fraudster can be tracked down and prosecuted, but with 30 days of early ballot processing, the fraudulent vote cannot be removed from the final vote count.

For someone to commit voter fraud, they would need to know where and when to find another voter’s ballot, steal it, perjure themselves by signing the envelope, get it back to the Clerk without leaving a trail, and be certain that the voter will not attempt to vote or that the Clerk will not catch on, while facing severe penalties if caught.

NOT REALLY (ROPER’S RESPONSE). As we saw in 2020, many ballots showed up in the wrong mailboxes, or for previous residents who moved away, or for family members no longer living in the household. Getting hold of such ballots won’t be that hard. Someone willing to commit fraud isn’t worried about perjuring themselves. Putting the absentee ballot in a mailbox or a ballot drop box leaves no trail, and, as pointed out above, it doesn’t matter if the real voter shows up or not, the fraudulent vote will be counted.

All to change the results by a single vote — it’s just not worth the high probability they would be caught.

FALSE (ROPER’S RESPONSE). Many Vermont house races are won/lost by a handful of votes. The speaker of the house lost her 2020 race by 19 votes. If I feel strongly about a race, and absentee ballots show up at my house for the previous resident, my two kids who are away at college and not intending to vote, and my aging parent who has dementia, nothing in S.15 can stop me from filling out all those ballots and sending them in, and, contrary to the statement above, as Clerks and the Director of Elections testified, there is almost ZERO chance I would be caught.

In the 2020 general election, we sent ballots out to all Vermont active voters, yet we did not hear of a single instance of voter impersonation.

YUP (ROPER’S RESPONSE). This more likely a reflection of the lack of security in the system than working security.

It would be wrong to lump all opponents of S.15 in with the ‘Stop the Steal’ conspiracy crowd who are using UV lights to search for bamboo fiber on ballots, but the arguments are the same and share a lack of evidence. They also pose the same serious risk: unduly undermining voter confidence in our election process. Let’s not fall into that trap.

Vermont is poised to become one of the most voter friendly states in the entire country, at a time when legislatures are using conspiracy theories and outright lies to restrict the constitutional rights of their citizens.

We have an opportunity to do better, and to be a beacon for the nation, showing what truly accessible and secure elections look like.

FALSE (ROPER’S RESPONSE). While under S.15 voting would be very accessible, it would not be at all secure. We should therefore go back to the drawing board and come up with a plan that actually reflects this goal — truly accessible AND SECURE elections.

    All you have to do is drive around and collect them from apartment lobbies or pay people $100 for their ballot.

  2. Ensuring fraud-free elections should be a prime concern of all voters, and VT Attorney General Donovan, and Secretary of State Condos.

    Voter ID, with photo, should be an absolute minimum to ensure the person showing up to vote is indeed that person.

    The following should be on file with Town Clerks for each registered voter:

    Voter signature
    Passport photo
    Birth certificate
    Proof of legal residence, such as bank accounts, property tax receipts, driver license, etc.
    Proof of citizenship,

    Voter ID, with photo and signature, must be on record with Town Clerks, as a pre-requisite for requesting a mail-in ballot.
    Each mail-in-ballot ENVELOPE must be signed, and dated, by the absentee voter.

    NOTE: Airlines require photo IDs to get on a plane, plus a passport with photo, for international flights.
    It would be dereliction of duty not to require proper IDs for voting.

    COUNTING

    However, the COUNTING of the votes is even more important.
    If that counting takes place in Dem/Prog controlled counting centers, staffed by pre-selected Dem/Prog counters/operatives, all sorts of “election results” can be fabricated, as was shown in Windham, New Hampshire in 2020.

    Strictly regulate the circumstances and methods of COUNTING the votes.
    None of the counting machines should be programmable by insiders and outsiders
    None should be connectable to the internet and other computers by means of wired or wireless networks.
    None should have an insertable, programmable electronic card
    Abolish all absentee voting, except for special cases.
    Abolish all ballot drop boxes.
    Abolish motor-voter
    Abolish same-day registration and voting
    Abolish out-of-state students from voting. They would not be “deprived”, because they can, and should, vote in their own state.

    NOTE: The Legislature of New Hampshire became Republican, because the “activist student vote” was absent. They likely also voted in their own states. After all, every vote counts!

    Suppose I get my mailed ballot and vote it and return it.

    Then I deviously show up on voting day, and say I never got a ballot, I want one now!
    What is to stop me, there is no check off, there is no ID on the ballot I mailed my secret ballot in.
    So, Do I get another ballot for my white lie??

    • Yes. You would have to sign an affidavit that you did not send in that absentee ballot (the veracity of that statement can’t be confirmed or challenged), and you would be given another ballot to vote in person. Because the 30 day allowance for absentee ballot processing, the absentee ballot would have already been counted and your double vote impossible to remove from the final vote count.

  4. US Constiturion, Article 1, Section 3

    The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing (sic) Senators.

    The Vermont legislature is entirely responsible for the rules and regulations of federal elections within Vermont.

    The US Constitution does not mention any Secretaries of State or the Executive branch.

    That means the legislature, which was elected by the people, should set up an Elections Committee, responsible for making rules and regulations, and for mailing out ballots, receiving them, and counting them.

    Electing representatives to act as proxies is the “people’s business”, in the spirit of “We the people….”

    The Executive branch, including the Governor and Secretary of State, plays NO ROLE in elections.

    The Far Beyond Credible Biden “Win”

    It is far beyond credible Biden could have so many votes by winning so few counties.

    Biden “shattered” the popular vote record, but:

    – Won only 477/2974 = 16% of all counties, a record low!
    – Lost a part of Black & Hispanic support
    – Lost 18 of 19 Bellwether Counties
    – Lost Ohio, Florida, Texas and Iowa; the first candidate to win by losing these 4 states, in US history; far beyond credible!!
    – Lost 25 of 26 House “Toss-Ups”
    – Instead of gaining 15 US House seats, as predicted by polls, Democrats lost 14 seats.

    Those statistics do not indicate a BLUE WAVE, but exactly the opposite.

    The only conclusion is ballot box stuffing, on a grand scale, in the major cities, controlled by Democrats, in swing states

  6. Manufacturing Phantom Votes in Bethpage, Long Island, NY, for Use in Pennsylvania

    This article describes in detail how up to 280,000 Phantom ballots were manufactured in Long Island, NY, transported from the USPS Center in Bethpage, Long Island, NY, via the USPS Center in Harrisburg, PA, to the USPS Center in Lancaster, PA, on October 21, TWO WEEKS BEFORE THE ELECTION

    Jesse, the trailer-truck driver, who transported the ballots, left his trailer at the loading dock of the USPS Center in Lancaster, PA, and went home with his tractor.

    When he came back the next day to pick up, what he thought would be, his empty trailer (he had been doing this for 18 months each day), found HIS TRAILER WAS GONE. It still has not been found.

    I think this likely was just ONE batch of PHANTOM ballots, later converted to counted votes, as part of the extended “count all the votes” mantra.

    The leaders of the USPS Centers had to be complicit (aiding and abetting) to make the fraud happen.

    Those ballots, by themselves, were more than sufficient to swing PA from Trump to Biden.

  7. Some Ways to Prevent Fraudulent Elections

    Is there a requirement regarding the composition of the ballot paper?
    In the US, it would be tree fibers, but in China it would be rice fibers.

    What about running ballots more than once through the counting machines, while no one is looking, i.e., before regular hours, during regular hours, and after regular ours?

    What about requiring time-stamping ballots when they are run through the counting machine?
    What about dead people voting?
    What about felons voting, in or out of jail, or on parole?
    What about out-of-staters voting, whether they own a house in Vermont or not?
    What about non-citizens voting?
    What about illegal aliens voting, documented or not?
    What about under-age people voting?
    What about out-of-state students voting in Vermont and in their own state?
    What about mail-in ballot without fold-marks; would they be rejected or waived through?
    What about same-day registration and voting, often without proper documentation?
    What about people getting a driver’s license, and also getting automatically added to a registered voter list, even though they would
    not have proper documents on file with a Town Clerk?
    What about forensic counting of ballots? Inexpensive machines are available
    What about counting machines that can be connected to the internet? They can be hacked by anyone in the world.
    What about counting machines that have slots for inserting programmable cards? Such cards can be altered with a few lines of code by any computer programmer.

    Voter List Manipulation

    In Democrat-controlled Vermont cities and towns, feeding fake ballots (stuffing the ballot box) is a common practice.
    Manipulating voter lists provides corrupt election officials more names to “play” with, to enhance Democrat power and command/control.
    1) Not deleting dead people
    2) Not deleting people who moved to another state
    3) Enabling non-citizens and illegal aliens to vote (with documents, or not)
    4) Enabling temporary residents to vote, even if they would reside less time in state than required by law
    5) Enabling convicted felons to vote (in jail or not)
    6) Enabling under-age people to vote
    7) Enabling feeble-minded people in nursing homes to “vote”, by filling in their ballots
    8) Enabling out-of-state students to vote.

    NOTE: The Legislature of New Hampshire became Republican, because the “activist student vote” was absent. They likely also voted in their own states.

    Voter Irregularities and Illegalities

  8. VERMONT; An Urgent Job for the Vermont Legislature

    Why is Vermont not introducing ELECTION SAFEGUARDS?
    Why wait to the last minute?

    Update documentation for each legal REGISTERED voter
    PURGE voter lists of dead people and those who moved out of state.

    That is easy to do.
    Just access Social Security records, tax records, US Census records, etc., and compare with voter lists
    Where there is a will, there is a way

    Methods of Voting

    There are 3 methods of voting:

    1) Appear in person
    2) Send absentee mail-in ballots to Town Clerks
    3) Drop mail-in ballots in drop boxes located throughout various states. Typically, those boxes are unsupervised/unmonitored, which means the “chain of custody” is broken, i.e., in violation of election law.

    Town Clerks, etc., receive those ballots, and are required, by law, to verify, USING DOCUMENTS ON FILE FOR EACH REGISTERED VOTER:

    1) Voter has full signature; not just a scribble
    2) Voter has up-to-date voter IDs; not something 20 years old.
    3) Voter met residency requirements; utility bills, local and state tax bills, driver’s license, car registration, tax returns, social security record.
    4) Address must be physical domicile, i.e., not a parking lot, warehouse, business, PO box, etc.
    5) Residency should be at least 6 months.
    6) Voter is dead or alive,
    7) Voter met age requirements,
    8) Voter is a citizen, i.e., born in the US (copy of birth certificate, preferably notarized) or naturalized (copy of citizen papers)

    After checking all those criteria, Town Clerks, etc., mark the voters as having voted, on registered voter lists.
    The total of such markings is called the turnout, which is reported by Town clerks to State election officials.

    Ban out-of-state students to vote in their school state. They should vote in their own state, via an absentee ballot.

    Ban “no-excuse absent” voting. To qualify to vote Absentee: Voters would have to be:

    1) 75 years old or older,
    2) Absent from their precinct,
    3) Observing a religious holiday,
    4) Physical disabled,
    5) Providing constant care for someone with a physical disability, or
    6) Working “for the protection of the health, life, or safety of the public during the entire time the polls are open”

    Ban automatic voter registration, such a “motor-voter”, which would enable un-documented and non-citizens to vote

    Ban ballot drop boxes, which would minimize “ballot box stuffing”

    Ban universal mailing of absentee ballots: Voters should be required to provide identification when they request an absentee ballot application.

    Election officials and official campaign organizations would be allowed to distribute, but various outside groups and nonprofit organizations would be banned from sending absentee ballot applications to voters.

    Increase poll watcher access: No processing of ballots and subsequent counting of ballots, at any time, without adequate poll watcher observation.

    Ban “brand-new” residents from voting in runoff elections.

    Mandate monthly updates to election officials of voters who have died or moved out of state

    Repeal “permanent-early-voting”, which allows a voter to automatically receive a ballot by mail for every election.

    NOTE: Town clerks have stated they cannot check these criteria, because their records lack sufficient documentation.

    NOTE: Mail-in voting takes fraud opportunities to a whole new level, as was proven during the past election.

    Voter ID, with photo, should be an absolute minimum to ensure the person showing up to vote is indeed that person.

    Voter signatures should be on file with Town Clerks for each registered voter

    Voter ID, with photo, should be required for ALL mail-in ballots, plus each mail-in ballot ENVELOPE must be signed, and dated, by the absentee voter.

    Airlines require photo IDs to get on a plane, plus a passport with photo, for international flights.
    It would be dereliction of duty for Vermont not to require proper IDs.

    However, the COUNTING of the votes is even more important.
    If that counting takes place in Dem/Prog controlled counting centers, staffed by pre-selected Dem/Prog counters/operatives, all sorts of “election results” can be fabricated, as was shown in New Hampshire in 2020.

    The Reveal of the COUNTING Fraud

  11. How many of Vermont voters will trust our state and federal election system in future?
    The process in Shelburne used to be secure—request an absentee ballot or vote in person. That will no longer be the case until this law is overturned. I have lost trust in election results in America.

    • So, how can you impeach the man when the man is a team player of all the people making the rules? Since there is no republican presence in the legislature, there is no ground swell and the rules all favor those who are enabling this scam, how would you propose that impeachment is even possible? Combine that with existing constitutional rules and laws and we are duped again by the SOS who has nothing to do with constitutional election laws other than to enforce them after they are passed and you have another nothing!

      • Chapter II, Section 57 of the Vermont Constitution states that the House can order impeachments by a two-thirds vote of its members. Section 58 states that “[e]very officer of State, whether judicial or executive, shall be liable to be impeached”….

        The process can begin with just one courageous house member making a motion. It would be a start.

    I keep seeing in the media that ballots would be sent to all “active and registered voters”, but it seems that ballots were and would be sent to every registered voter whether active or not. Can you shed some light on how the status of “active” is determined? If a voter is registered but not active there could be several reasons, apathy, too busy, moved out of state, been dead for ten years.

    • Hi Allen. S.15 would send ballots to all “active” voters on the checklist. To be considered an “inactive” voter your status has to have been formally challenged, ie, someone has to make a credible claim that you no longer live where you’re registered, which is then followed up with a multiple election cycle process of sending post cards asking for confirmation of your address before election officials can remove you from the check list.

      An irony I failed to mention in my piece… If I got the ballot of someone who moved out of state and sent it in, that person will be on record as having voted, making them an active voter in the eyes of election officials, ensuring that another ballot will be sent to them in the next election, and making it harder to remove that person from the checklist. It’s a mess.

      • So, in effect then, the distinction between ‘active’ and ‘registered’ voters is virtually non-existent. Everyone on the voter checklist will have a ballot mailed to them.

        For example, in my Town of Westminster, a high voter turnout is typically 600-700 voters out of 2400 registered on the voter checklist. Last November, the State mailed 2400 ballots to town voters, 1600 were cast (more than twice the expected return), and 800 were unaccounted for.

        Interestingly, four weeks later, in a controversial anti-school merger vote brought on by Act 46, for an Australian Ballot one would expect a high voter turnout, only 268 people voted, even though mail-in ballots were also allowed.

        Further, when I voted in person on the merger, my ballot was first rejected by the vote tabulating machine and then counted on the second try. Of course, I have no idea whether or not my ballot was tabulated properly, in November or on the school merger issue four weeks later.

        Clearly, no one knows for certain. Least of all SOS Condos.
